Indemnification
You agree to defend, indemnify and hold NationwideBath.com and its Principals harmless for any loss, damages or costs, including reasonable attorneys’ fees, resulting from any third party claim, action, or demand resulting from your use of the Site. You also agree to indemnify us for any loss, damages, or costs, including reasonable attorneys’ fees, resulting from your use of software robots, spiders, crawlers, or similar data gathering and extraction tools, or any other action you take related to our website.
Typographical Errors
In the event a product is listed at an incorrect price due to a typographical error, entry error or error in pricing information received from our suppliers, NationwideBath shall have the right to refuse or cancel any orders placed for said product(s). If your credit card has already been charged for the order and the order is cancelled, NationwideBath will immediately issue a credit to your account in the amount of the incorrect price.
Product Pricing
NationwideBath.com strives to provide accurate product and pricing information. However some items on our website may be mispriced. NationwideBath.com reserves the right to correct any errors, inaccuracies or omissions and to change or update information (including, without limitation, information related to text, pricing, availability and product descriptions) at any time without notice (including after you submitted your order and confirmation was received). In the event that an item is shown on our website at an incorrect price or with incorrect information, NationwideBath.com shall have the right, in its sole discretion, to refuse or cancel any orders placed for that item. If your credit card (or other form of payment) has been charged for any order subsequently cancelled, NationwideBath.com will issue a credit to your credit card or other form of payment. Prices and availability are subject to change without notice. We apologize for any inconvenience this may cause you.
Product Descriptions
NationwideBath.com attempts to be as accurate as possible. However, NationwideBath.com does not warrant that product descriptions or other content of this site is accurate, complete, reliable, current, or error-free. If a product you purchase from us is not as described, your sole remedy is to return it in unused condition.
We have also made every effort to display as accurately as possible the colors and finishes of our products that appear on the site. However, as the actual colors you see will depend on your monitor, we cannot guarantee that your monitor's display of any color or finish will be accurate.
Order Acceptance Policy
Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. NationwideBath reserves the right, at our sole discretion, at any time after receipt of your order to accept or decline your order for any reason. Some situations that may result in your order being canceled include limitations on quantities available for purchase, inaccuracies or errors in product or pricing information, or problems identified by our credit and fraud avoidance department. We may also require additional verifications or information before accepting any order. If your order is canceled after we have received your payment we will issue a credit equal to the amount of the original payment.
Accepting Product Deliveries
By ordering products from NationwideBath you agree to accept any and all product deliveries to your home or business without a signature required by you (our customer).
Sales Taxes
NationwideBath withholds applicable sales tax orders to be delivered to addresses within the state of Idaho. Each customer shall be solely responsible for all sales taxes, or other taxes on orders shipped to any other location.
Collection of Payment
Your credit card (or other form of payment) will be charged and collected at the time you place your order.
Product Availability
Product Availability is subject to the Stock on hand. When your order is processed at the warehouse your product may not be available for immediate shipment. In this case you will be notified by email if part or all of your order is backordered. If a backordered item is unable to ship within 30 days, NationwideBath.com will attempt to contact you to inform you of the extended lead-time. You will then have the right to accept the new lead-time or cancel the order for a full refund.
NationwideBath.com is not responsible in any way for losses incurred by customer due to scheduling and/or project delays associated with installation and/or plumbers, contractors, or any other professional installers or persons.
Shipping Freight Damage Responsibility
Products that are oversized and/or are too heavy cannot ship FedEx ground and must be shipped via LTL (less-than-truckload) by a freight carrier. These freight carriers are private trucking companies and are also known as common carriers. At NationwideBath we want to insure that your products arrive to you in excellent condition that is why we require that our customers be home at the time of delivery to inspect and sign for items that are shipped via LTL.
It is important that you inspect your shipment thoroughly before accepting and signing for your merchandise; after you sign for the merchandise you are responsible for filing all damages and we cannot send a replacement or issue credit for the damages.
Do not assume that your product is not damaged just because the box and packaging is intact. You must check for both internal and external damage before you accept delivery. If you receive a shipment with obvious or concealed freight damage, refuse the shipment and note the damage on the bill of lading. *With the exception of Aquarius products, Homeward Bath, Cambridge Plumbing, Dreamline & Ariel Products, Please call our customer service department immediately at (888) 622-9411 and inform us of the damage. *With the exception of Aquarius products, Homeward Bath, Cambridge Plumbing, Dreamline & Ariel Products, items that have been inspected and refused by the consignee at time of delivery due to damage may be replaced. We will send a replacement once the original product is returned, or we can charge you for the replacement and credit you upon the return of the original. * For Any Aquarius products, Homeward Bath, Cambridge Plumbing, Dreamline & Ariel Products products which have been inspected for damage and refused by consignee at time of delivery due to damage, the consignee must note any and all damage on the carriers Bill of lading and immediately file a damage claim directly with the freight carrier. Nationwidebath.com is not responsible for refunding purchase price and Freight costs due to freight damage.
If you sign for the shipment without reporting any damage you are responsible for all damages and and we cannot send a replacement or issue credit for the damages. Please make sure that you inspect all packages before you sign for them.
Product Installations
NationwideBath.com shall not be held liable or responsible for any costs, damages, or injuries associated with installations. This includes any damages that may result by installing the product(s) correctly or incorrectly and/or any defects in products.
NationwideBath.com is not responsible in any way for losses incurred by customer due to scheduling and/or project delays associated with plumbers, contractors, or any other professional installers or persons.
Return Policy
All PURCHASES ARE SUBJECT TO OUR RETURN POLICY AND IT IS IMPORTANT THAT YOU REVIEW THIS POLICY IN DETAIL BEFORE PLACING AN ORDER. OUR RETURN POLICIES ARE LIMITED BY AND LIMITED TO THE RETURN POLICIES OF EACH INDIVIDUAL FACTORY OR MANUFACTURER.
